Welcome to JodyTjan.com (the “Website”). The Website is operated by Jody Tjan (“Jody Tjan,” “we,” “us,” or “our”), based in New York, United States.
These Terms of Use (“Terms”) govern your access to and use of the Website and any content, features, booking tools, educational programs, styling services, consultations, virtual sessions, personalized materials, and other products or services offered through the Website (collectively, the “Services”).
By accessing or using the Website, creating an account, booking a session, enrolling in a program, submitting information, or making a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website or Services.
1. Eligibility
You may browse the Website if you can lawfully do so. You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, make a purchase, book a session, enroll in the Jody Tjan System of Style Academy, or use any paid Service.
We do not knowingly accept paid bookings, purchases, or enrollment from anyone under 18.
2. Nature of the Services
The Website may offer personal-style education, styling services, the Jody Tjan System of Style Academy, the Jody Tjan Style Diagnostic, Foundation Studies: The Architecture of Personal Style, Semester One, Semester Two, Returning Graduate, Style Sessions, the Fashion Industry Intensive, consultations, virtual sessions, personalized style guides, and related offerings.
The specific scope, format, schedule, price, prerequisites, deliverables, and other details of each Service are described on the applicable sales, booking, enrollment, or checkout page. Certain Services may also be governed by a separate written agreement, enrollment agreement, proposal, or policy. If a separate written agreement conflicts with these Terms, the separate agreement controls for that Service.
We may modify, replace, suspend, or discontinue any Website feature or future offering. Changes will not remove rights you have already acquired under applicable law or materially alter a Service you already purchased without appropriate notice or a lawful remedy.
3. Educational and Informational Purpose
The Website and Services provide education, analysis, professional perspective, and personalized guidance. They do not constitute medical, mental-health, legal, tax, financial, employment, or other regulated professional advice.
Style analysis may involve professional judgment and subjective considerations, including proportion, silhouette, color, fit, personal preferences, lifestyle, presentation, and aesthetic goals. Recommendations are not guarantees of a particular personal, social, professional, financial, or career result. You remain responsible for your own choices, purchases, alterations, wardrobe decisions, business decisions, and use of the information provided.
4. Account Information
If the Website allows you to create an account, you agree to provide accurate, current, and complete information; keep your login credentials confidential; and promptly update information that changes.
You are responsible for activity conducted through your account unless caused by our failure to use reasonable security measures. Notify us promptly at contact@jodytjan.com if you believe your account has been accessed without authorization.
We may suspend or terminate an account that contains false information, is used unlawfully, compromises Website security, infringes another person’s rights, or materially violates these Terms.
5. Bookings, Enrollment, and Client Responsibilities
You are responsible for reviewing the description, prerequisites, timing, technology requirements, and policies shown before completing a booking or purchase.
To receive the intended benefit of a Service, you agree to:
provide accurate and sufficiently complete questionnaires, measurements, photographs, goals, preferences, and other requested materials;
submit required materials by the stated deadlines;
attend scheduled virtual sessions on time with a working internet connection and compatible device;
participate respectfully and without disrupting the experience of others; and
follow reasonable preparation and scheduling instructions associated with the Service.
Delays, missed deadlines, incomplete submissions, inaccurate measurements, poor-quality photographs, technology problems on your side, or failure to participate may affect the timing, quality, or completion of the Service. We are not responsible for results affected by information you omit or provide inaccurately.
Unless we expressly agree otherwise in writing, a booking or enrollment is personal to the purchaser and may not be transferred, shared, resold, or assigned to another person.
6. Scheduling, Cancellations, Rescheduling, and Refunds
The cancellation, rescheduling, lateness, no-show, expiration, and refund terms displayed on the applicable booking page, checkout page, confirmation email, or separate service agreement are incorporated into these Terms. Please review them before purchasing.
If different terms are presented for a particular Service, the Service-specific terms control. Except where required by law or expressly stated in the applicable Service-specific policy, fees are not refundable merely because you change your mind, fail to attend, do not submit requested materials, or do not complete a program.
If we cancel a scheduled Service and cannot offer a reasonable replacement date, we will provide the remedy stated in the applicable Service policy or, if none is stated, a refund for the portion of the paid Service that we did not provide.
Nothing in these Terms limits any non-waivable cancellation, refund, or consumer right provided by applicable law.
7. Prices and Payments
Prices are stated in U.S. dollars unless otherwise indicated. You agree to pay the price and any applicable taxes or disclosed fees presented at checkout.
Payments may be processed by Stripe, Squarespace Payments, or another third-party payment provider identified at checkout. Your payment is also subject to the provider’s applicable terms and privacy practices. We do not receive or store your complete payment-card number.
You represent that you are authorized to use the payment method submitted. If a payment is declined, reversed, charged back, or otherwise not completed, we may pause or cancel the related booking, enrollment, delivery, or access to the extent permitted by law. Contact us first at contact@jodytjan.com if you believe a charge is incorrect so we can investigate.
8. Intellectual Property
The Website and its original content—including text, curricula, course structure, frameworks, methods, lessons, presentations, videos, graphics, branding, questionnaires, worksheets, downloads, style guides, and other materials created by or for Jody Tjan—are owned by or licensed to Jody Tjan and are protected by copyright, trademark, and other applicable laws.
Your purchase or enrollment gives you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the materials provided to you for your own personal or internal professional learning, as applicable. It does not transfer ownership of the materials or of the Jody Tjan System of Style.
Unless we give you prior written permission, you may not:
copy, reproduce, republish, upload, post, transmit, sell, license, distribute, or commercially exploit Website or Service materials;
share paid materials, account access, recordings, links, downloads, or personalized guides with another person;
record a session, class, presentation, or consultation;
teach, adapt, repackage, or create a competing course, service, framework, or commercial product from the materials;
remove copyright, trademark, authorship, or proprietary notices; or
use Jody Tjan’s name, likeness, trademarks, logos, course names, or branding in a way that suggests sponsorship, endorsement, affiliation, or permission that has not been granted.
You may print or save materials expressly made downloadable for your permitted personal use. Any broader use requires prior written permission.
9. Materials You Submit
You retain any ownership rights you hold in questionnaires, measurements, comments, photographs, outfit images, and other materials you submit (“Client Materials”).
You give us a limited, non-exclusive permission to receive, store, copy, review, annotate, and otherwise use Client Materials only as reasonably necessary to provide the requested Services, communicate with you, maintain appropriate business records, protect legal rights, and comply with law, as further described in our Privacy Policy.
You represent that you have the right to submit the Client Materials and that our permitted use of them will not violate another person’s copyright, privacy, publicity, or other rights. Do not submit photographs or personal information about another person unless you have the authority and any consent required to do so.
We will not use your Client Materials, name, image, testimonial, or results in advertising, social media, case studies, portfolio materials, or other public promotional content without separate permission. You may withdraw future promotional permission as described in the applicable release, although withdrawal will not require us to undo uses already lawfully made before the withdrawal.
10. Feedback and Honest Reviews
If you voluntarily send us suggestions or general feedback about the Website or Services, you allow us to use that feedback to operate and improve the business without compensation or attribution. This does not give us ownership of your Client Materials or of the intellectual property in an honest consumer review.
Nothing in these Terms restricts your right to provide an honest review or express a lawful opinion about our products, Services, or conduct.
11. Prohibited Conduct
You may not use the Website or Services to:
violate any law or another person’s rights;
impersonate another person or misrepresent your identity or affiliation;
submit unlawful, threatening, harassing, defamatory, obscene, infringing, malicious, or deceptive material;
introduce viruses, malware, harmful code, or other disruptive technology;
attempt to gain unauthorized access to an account, system, server, or nonpublic material;
scrape, harvest, crawl, data-mine, or use automated means to extract Website content except as permitted by law or our written authorization;
interfere with the Website’s security, operation, or availability;
use Website content or Service materials to train, develop, test, or improve an artificial-intelligence or machine-learning system without prior written permission; or
use the Website or Services for fraud, resale, unauthorized commercial exploitation, or any purpose inconsistent with these Terms.
12. Third-Party Services and Links
The Website may use or link to third-party services, including Squarespace, Acuity Scheduling or Squarespace Scheduling, Stripe, social-media platforms, video-conferencing services, email providers, embedded content, and other websites.
Third parties operate independently and may apply their own terms and privacy policies. We do not control and are not responsible for third-party content, availability, security, policies, products, or conduct. A link or integration does not necessarily mean we endorse the third party.
13. Testimonials and Examples
Testimonials, reviews, photographs, case studies, and examples reflect the experiences or opinions of the individuals involved. They are not promises or guarantees that you will receive the same or similar results. Individual outcomes vary based on goals, participation, circumstances, preferences, implementation, and other factors.
14. Website Availability and Disclaimer of Warranties
We use reasonable efforts to maintain the Website and provide the Services as described. However, websites and online services may occasionally be interrupted, delayed, unavailable, or affected by technical errors, maintenance, security events, or circumstances beyond our reasonable control.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ALL GENERAL WEBSITE CONTENT WILL ALWAYS BE COMPLETE, CURRENT, OR ACCURATE.
This section does not disclaim an express written commitment made for a paid Service and does not limit any warranty or consumer right that cannot lawfully be excluded.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JODY TJAN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE WEBSITE OR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, JODY TJAN’S TOTAL LIABILITY ARISING FROM OR RELATED TO A PARTICULAR PAID SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO JODY TJAN FOR THAT SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. FOR A CLAIM BASED ONLY ON USE OF THE FREE WEBSITE, TOTAL LIABILITY WILL NOT EXCEED $100.
These limitations do not apply to liability that cannot lawfully be limited or excluded, including where applicable liability for fraud, willful misconduct, or personal injury caused by negligence.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Jody Tjan from third-party claims, damages, liabilities, judgments, and reasonable costs arising from your unlawful use of the Website or Services, your material violation of these Terms, or Client Materials you submit that infringe or violate a third party’s rights.
This obligation does not apply to the extent a claim was caused by Jody Tjan’s own unlawful conduct, negligence, or breach of these Terms.
17. Suspension and Termination
We may suspend or terminate your access to the Website or a Service if you materially violate these Terms, misuse the Website, threaten the safety or rights of another person, fail to make a required payment, or engage in conduct that makes continued performance unlawful or impracticable.
When reasonable under the circumstances, we will provide notice and an opportunity to correct the issue. Serious misconduct, fraud, security threats, harassment, infringement, or unlawful activity may result in immediate action.
Termination does not eliminate payment obligations already incurred or provisions that by their nature should continue, including provisions concerning intellectual property, submitted materials, disclaimers, limitations of liability, indemnification, disputes, and general legal terms.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Before filing a legal claim, you and Jody Tjan agree to make a good-faith effort to resolve the dispute informally by sending a written description of the issue and requested resolution to contact@jodytjan.com. Either party may proceed after 30 days if the dispute has not been resolved. This informal process does not prevent either party from seeking urgent injunctive relief or filing in small claims court, and it does not extend a legal deadline unless the law or a written agreement says otherwise.
Any court proceeding arising from these Terms or the Website must be brought in a state or federal court with jurisdiction in New York County, New York, unless applicable law gives you the right to bring a claim elsewhere. You and Jody Tjan consent to the jurisdiction of those courts.
19. Changes to These Terms
We may update these Terms to reflect changes in the Website, Services, business practices, or law. The updated Terms will be posted on this page with a revised effective date.
Changes apply prospectively from the effective date. If a change materially affects an ongoing paid Service, we will provide additional notice when required by law. Your continued use of the Website after updated Terms take effect means you accept the revised Terms. The version in effect when you completed a purchase will continue to govern that transaction unless you expressly agree otherwise or a change is required by law.
20. General Terms
These Terms, the Privacy Policy, any Service-specific policies presented before purchase, and any applicable separate written agreement constitute the entire agreement concerning the Website and relevant Services.
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a lawful sale, reorganization, or transfer of the business or its assets.
Nothing in these Terms creates an employment, partnership, joint-venture, franchise, fiduciary, or agency relationship between you and Jody Tjan.
